General Terms and Conditions for www.3d-models.shop

§ 1 Scope of application, customer information

The following General Terms and Conditions (GTC) govern the contractual relationship between Software-Service John GmbH (hereinafter referred to as the Seller) and end customers (hereinafter referred to as the Buyer) who purchase goods via our shop www.3D-Models.shop. We do not recognise any terms and conditions that contradict or deviate from our terms and conditions. The contract language is German.

§ 2 Conclusion of contract

(1) In our shop we offer digital goods that the buyer can purchase.

(2) You can place one or more products in the shopping basket. During the ordering process, you enter your data. Only when you click on the order button do you accept the offer to conclude a purchase contract. However, you can also conclude the purchase contract by telephone or e-mail.

§ 3 Customer information: Storage of the contract text

Your order with details of the contract concluded (e.g. type of product, price, etc.) will be stored by us. The buyer can access the GTC at any time via our website. As a registered customer, you can access your past orders via the customer login area.

§ 4 Customer information: Correction note

You can correct your entries at any time before submitting your order. We will inform you of further correction options as you progress through the order process. You can also end the order process completely at any time by closing the browser window.

§ 5 Purchase process, download

1. Once the buyer has ordered the goods in the shopping basket, they must enter their details for the purposes of invoicing and shipping.
2. At the same time, the buyer can optionally create a personal account.
3. After payment, the buyer receives a confirmation e-mail with a link to download the purchased goods and the corresponding invoice.
4. This link is valid for seven days from receipt of the e-mail and can only be used once.
5. If the buyer has created an account at www.3D-Models.shop, they can track their orders, invoices and download links via the login area as an overview. These links are also valid for seven days and can only be used once.

§ 6 Retention of title

The object of purchase remains our property until full payment has been made.

§ 7 Reservation of use

All models, symbols, textures etc. purchased via the shop 3D-Models.shop may only be used by the buyer for his own purposes. Resale to third parties is prohibited! The only exception is resale in the form that the buyer sells the models, symbols, textures etc. encapsulated within his own software (e.g. games) to his customers.

§ 8 Statutory liability for defects and limitation period

(1) Warranty rights
Statutory warranty rights exist for our goods.

(2) Warranty towards entrepreneurs
Your warranty claims due to defects in the purchased item expire one year after the transfer of risk. The following claims are excluded from this regulation

• for damages
• due to fraudulently concealed defects
• from any guarantee given
• on recourse according to §§ 445a, 478 BGB

The statutory limitation periods shall apply to these excluded claims. In the event of a warranty period, the longer period shall apply in favour of the buyer.

§ 9 Limitation of liability

We exclude liability for slightly negligent breaches of duty insofar as these do not relate to material contractual obligations, damage resulting from injury to life, limb or health, guarantees or claims under the German Product Liability Act (ProdHaftG). The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations include in particular the obligation to hand over the item to you and to procure ownership of it for you. Furthermore, we must provide you with the item free of material defects and defects of title.

§ 10 Commercial place of jurisdiction

The exclusive place of jurisdiction for all disputes arising from this contract is the registered office of the seller.

§ 11 Right of cancellation

When purchasing digital content (e.g., models, icons, textures, etc.) that is not supplied on a physical data carrier, the statutory right of withdrawal expires once the buyer has expressly agreed that the execution of the contract shall begin before the withdrawal period ends and has confirmed that they thereby lose their right of withdrawal.

The buyer is informed of this before completing the purchase in the online shop and must expressly agree to this waiver.

Important Notice:

By purchasing the digital content, the buyer expressly declares that they waive their right of withdrawal. Therefore, returns or refunds are excluded once the purchase has been completed.
